How Can I Get My Driving Privileges Back in New Mexico?

First Offense vs. Second Offense in New Mexico
A first-time DUI offense in New Mexico can result in up to 90 days in jail and up to $500 in fines. The driver will also have their license revoked for six months to a year and must have an ignition interlock device on their vehicle for an entire year. Other requirements include 24 hours of community service, alcohol abuse screening and treatment programs, and mandatory Driving While Intoxicated (DWI) school.
For a second DUI offense, the punishments get a little more severe. The driver could spend up to 364 days in jail but will have a mandatory stay of 96 hours, at minimum, following the incident. The driver’s fines will be between $500 and $1,000, and their license will be revoked for two years. Additionally, the driver must have an ignition interlock device on their vehicle for two years, do 48 hours of community service, and complete an alcohol abuse screening and treatment program. A second DUI offense can also result in up to five years of probation for the driver.

New Mexico Laws and Regulations
